TrustedID Reppler is a social reputation monitoring service designed to keep your online image clean and safe. Please carefully read the following for information regarding the terms under which TrustedID makes its services available for your use.
It is important to understand that the following terms and conditions ("Terms") are a legally binding agreement between you andTrustedID, its affiliates, and agents (all collectively, "TrustedID"). These Terms govern your use of the TrustedID Reppler Application, the TrustedID Reppler Website, and other Reppler online services (all collectively, "TrustedID Reppler").
Acceptance of Terms
By accessing, browsing and/or using TrustedID Reppler, you acknowledge that you have read, understood, and agree to be bound by these Terms and to comply with all applicable laws and regulations. If you do not agree, do not use TrustedID Reppler.
In using TrustedID Reppler, you represent and warrant that you are at least 18 years of age or are otherwise able to enter into a legally binding contract.
Your License
TrustedID grants to you and you fully accept, upon delivery, a personal, limited, non-exclusive and non-transferable right to use TrustedID Reppler. This license enters into force through your acceptance as defined above and no title shall pass to you. In addition to the license granted in this section, you shall have the right to access TrustedID Reppler in accordance with the Terms. All rights and licenses not expressly granted to you under this agreement shall be retained by TrustedID.
TrustedID's License From You
TrustedID requires access to and use of certain Content and information relating to your use of social media platforms and services in order for TrustedID to provide TrustedID Reppler. By using TrustedID Reppler, you authorize and permit TrustedID to access third party social media services to retrieve information about your account, and access and use information submitted by you to third party social media services to provide TrustedID Reppler. You are solely responsible for all Content submitted to or available through TrustedID Reppler ("Content"). Examples of such Content may include user posted Content, URLs and other information that you may visit, share or receive from others through your use of social media services. By authorizing access, submitting, posting, or displaying Content through TrustedID Reppler (for example to validate Content), you give TrustedID a license to access, use and disclose such Content in order to provide and develop TrustedID Reppler. By authorizing access, submitting, posting, or displaying Content through TrustedID Reppler, you represent and warrant that you have all the rights, power, and authority necessary to grant the above described license.
Content in TrustedID Reppler
TrustedID does not control, monitor, or have any detailed knowledge of the Content and other information presented and received through the use of TrustedID Reppler. Therefore, you may be exposed to information that is erroneous, indecent or otherwise objectionable. TrustedID shall not be liable for the Content and other information spread or delivered through or in connection with TrustedID Reppler. You agree that you shall bear all risks associated with your use of TrustedID Reppler.
Some Content may be protected by intellectual property rights owned by TrustedID or third parties. You acknowledge that nothing in TrustedID Reppler shall be construed as conferring any license to you from TrustedID, its subsidiaries, or affiliates or any third-party provider's intellectual property rights, whether by estoppel, implication. You may not modify, rent, lease, loan, sell, distribute or create derivative works based on such Content (either in whole or in part) unless you have been specifically told, in a separate written agreement, that you may do so by TrustedID or by the owners of that Content.
TrustedID reserves the right to remove any Content from TrustedID Reppler at any time, without cause, and without notice.
Privacy Policy
Your privacy is important to us. When you provide personal information to TrustedID through our Services, you expressly consent to the data protection, handling, and use policies described in the TrustedID's TrustedID Reppler Privacy Policy, which is incorporated into and is subject to these Terms.
No warranty
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW TRUSTEDID MAKES NO WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED WITH RESPECT TO TRUSTEDID REPPLER, THEIR QUALITY, PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. AS A RESULT, TRUSTEDID REPPLER IS PROVIDED "AS IS" AND YOU ARE ASSUMING THE ENTIRE RISK AS TO THEIR QUALITY AND PERFORMANCE.
You understand and acknowledge that TrustedID will not be liable for network-related problems attributable to the operation of TrustedID Reppler and that network configuration changes may affect the performance of TrustedID Reppler.
Limitation of Liability
YOU EXPRESSLY AGREE THAT TRUSTEDID SHALL IN NO EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS AND GOODWILL, ARISING OUT OF THE USE OR INABILITY TO USE TRUSTEDID REPPLER OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. For example, and without limitation, TrustedID shall have no liability for any information stored or processed with TrustedID Reppler including the costs of recovering such information. Your only right or remedy with respect to any problems or dissatisfaction with TrustedID Reppler is to cease use of TrustedID Reppler.
TRUSTEDID SHALL NOT BE LIABLE FOR THE VALIDITY AND CORRECTNESS OF THE CONTENT PROVIDED THROUGH AND IN CONNECTION WITH USE OF TRUSTEDID REPPLER. ANY USE OF INFORMATION OBTAINED THROUGH USE OF TRUSTEDID REPPLER SHALL BE DONE AT YOUR OWN DISCRETION AND RISK.
Support
TrustedID shall have no obligation to provide support or maintenance for TrustedID Reppler under this agreement. However, TrustedID may, at its sole discretion, provide limited technical support, upgrades and updates for TrustedID Reppler.
Access from Outside the U.S.
TrustedID Reppler is controlled and operated by TrustedID from its offices within the United States. TrustedID makes no representation that materials in TrustedID Reppler is appropriate or available for use in other locations, and access to them from territories where their Contents are illegal is prohibited. Those who choose to access TrustedID Reppler from other locations do so on their own initiative and are responsible for compliance with applicable local laws. If you use TrustedID Reppler from other locations, you are responsible for compliance with applicable local laws.
Termination
Your right to use TrustedID Reppler continues until this agreement is terminated. TrustedID may terminate this agreement and your use of TrustedID Reppler at any time, without cause and without notice. You may terminate this agreement at any time by ceasing use of TrustedID Reppler. This agreement will automatically terminate if you fail to comply with the Terms. Upon any termination, you agree to stop using TrustedID Reppler.
Provisions of sections No warranty, Limitation of liability, and Termination shall survive any termination of this agreement.
Severability
If any of the terms, or portions thereof, of these Terms are invalid or unenforceable under any applicable statute or rule of law, the court shall reform the Terms to include an enforceable term as close to the intent of the original term as possible; all other terms shall remain unchanged.
Waiver
The waiver or failure of TrustedID to exercise in any respect any right provided for in the Terms shall not be deemed a waiver of any further or future right under the Terms.
Assignability
TrustedID may freely assign and transfer this agreement to any third party.
Governing law and dispute resolution
These Terms shall be governed by and shall be construed in accordance with the laws of the State of California excluding its choice of law rules. You agree to submit to the exclusive jurisdiction of the state and federal courts with jurisdiction over Santa Clara County, California for the resolution of any and all disputes arising out of or relating to your use of TrustedID Reppler. You further agree and covenant not to bring suit in any other jurisdiction.
Revisions
TrustedID reserves the right to change these Terms at any time without notice to you other than through posting such modified Terms on the TrustedID Reppler Website. Please check these Terms periodically for changes. Your continued use of TrustedID Reppler after the posting of changes means that you agree to such changes.
